As the male performer attempts to hold the young woman from behind, his right hand appears to move across her left breast toward her right breast. His hand then appears to pause briefly on her right breast, making a movement that resembles a gentle squeeze, before he switches to holding the woman’s arm with both hands. The sequence has prompted questions about whether the physical contact was part of the scripted performance or went beyond what was necessary for the scene.

Lawyer Explains the Legal Implications
The controversy began after netizens noticed what they considered unusual movements in the circulating scene. The video subsequently sparked widespread discussion on social media, with related topics appearing among trending discussions. According to Sohu Entertainment, the investigation was not initiated by a formal complaint from the female extra who was allegedly affected. Instead, online viewers spotted the potentially inappropriate contact and discussed it publicly, prompting the production team to investigate.
Lawyer Fu Jian, head of the Henan Zejin Law Firm, offered an explanation of the legal implications. He said that if the conduct in question is found to constitute molestation under Article 44 of China’s Law on Administrative Penalties for Public Security Administration, the police may intervene and investigate under their legal authority.
However, Fu Jian explained that, in practice, cases of this nature generally require a report from the person concerned or valid leads as a basis for initiating an investigation. Since the female extra has not reported the incident to the police and the initial lead came from online posts, this could affect the handling of the case.
One of the central issues is determining whether the physical contact was part of a planned performance or constituted sexual harassment and an infringement of personal rights.
According to Fu Jian, the key considerations include whether the physical contact was specified in the script and whether the female performer had given her consent beforehand. An edited clip circulating online is insufficient on its own to establish what happened. Original footage from multiple camera angles, the script, and witness statements from people present on set are all important evidence in determining the facts.
If the investigation establishes that the male extra’s touching went beyond what was necessary for the performance, he could face civil liability. Under Article 1010, Paragraph 1, of China’s Civil Code, a person found to have committed sexual harassment may be required to stop the conduct and apologize. Depending on the circumstances and whether the relevant legal requirements are met, the person may also face administrative penalties under public security regulations.
Meanwhile, the production team’s potential legal liability will depend on whether it fulfilled its obligations to prevent and address sexual harassment in the workplace. Fu Jian cited Article 1010, Paragraph 2, of China’s Civil Code and Article 25 of the Law on the Protection of Women’s Rights and Interests.
If the production team is found to have failed to implement necessary preventive and management measures, thereby allowing the alleged misconduct to occur, it could be considered to have failed to meet its legal obligations to prevent sexual harassment. Where the legal requirements are satisfied, the production team could be held liable for compensation alongside the person directly responsible, either jointly or in proportion to their respective responsibilities.
Fu Jian also explained that if the inappropriate touching is substantiated, the female performer could file a civil lawsuit. Potential claims could include medical expenses, psychological counseling costs, a formal apology, and compensation for emotional distress, in accordance with applicable law.
